MOMENTS is not a medical device and does not provide medical advice. It is a personal record-keeping and communication tool for supported conditions, currently seizures and migraines. It cannot detect, predict, prevent, diagnose, or treat a medical condition.
In an emergency, call your local emergency number (911 in the United States) immediately. Do not rely on MOMENTS, its notifications, or a Care Circle for emergency response or life-safety monitoring.
These Terms of Service ("Terms") govern your use of the MOMENTS mobile app, browser workspace, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old to create an account. A parent or legal guardian may create and manage an account for a minor or another person in their care and is responsible for that use. You agree to provide accurate account information, keep your password confidential, and notify us if you suspect unauthorized access. You are responsible for activity performed through your account unless prohibited by law.
2. What MOMENTS does
MOMENTS lets primary account holders record and review supported health conditions, currently seizures and migraines, through a mobile app and browser workspace. Features may include condition-specific Moment entries, calendars, timelines, patterns, PDF reports, CSV exports, profile and safety details, notifications, and Care Circle sharing. Features and supported conditions may evolve over time.
The Service organizes information entered by users. It does not independently verify that information, make clinical interpretations, or guarantee that records or reports are complete or accurate.
3. Medical and emergency disclaimer
MOMENTS does not provide medical advice, diagnosis, treatment recommendations, emergency monitoring, or prediction. Information shown by the Service, including patterns and reports, reflects user-entered records and may contain errors or omissions. Always consult a qualified healthcare professional for medical decisions.
Notifications and Care Circle features can be delayed, missed, disabled, or unavailable. They are not emergency alerts. If someone may be in danger, contact local emergency services and follow the care plan provided by a qualified professional.
4. Your content
You retain ownership of the information you enter into MOMENTS. You give us a limited license to host, process, back up, display, and transmit that information only as needed to operate, secure, and improve the Service and to carry out the sharing choices you make.
You are responsible for the accuracy and lawfulness of content you submit and for having authority to enter information about another person. Do not enter unlawful, abusive, or intentionally misleading content.
5. Care Circle use
A Care Circle connects a primary account holder with one or more supporters. A supporter must request access and be approved by the primary before receiving access. The primary controls permissions for each relationship and may change or remove them at any time.
Supporters must use shared information only to support the primary and only within the permissions granted. They must protect its confidentiality, must not use it for discrimination or exploitation, and must not treat MOMENTS as an emergency-monitoring system. Available actions can differ by condition. At present, authorized supporter logging is available for seizures; migraines are logged by the primary account holder. Authorized supporters may add attributed notes where that permission is enabled.
6. Acceptable use
You may not misuse the Service, attempt unauthorized access, interfere with its operation, reverse engineer it except where law permits, transmit malicious code, scrape or harvest user information, impersonate another person, or use MOMENTS to violate another person's privacy or any law. We may limit or suspend access when reasonably necessary to protect users, the Service, or others.
7. Lifetime Access and purchases
MOMENTS is free to download and offers an optional Lifetime Access unlock through a single one-time in-app purchase. It is not a subscription. The features included with free access and Lifetime Access are shown in the app and may be refined as the Service evolves, without taking away access already purchased to the extent required by law.
Apple or Google processes the transaction under the terms of the store where you purchased it. We do not receive your payment-card details. RevenueCat helps verify and restore the purchase for your MOMENTS account. Refunds and store transaction disputes are handled under the applicable store's rules. Lifetime Access is tied to the MOMENTS account and purchase record used for the transaction; keep your sign-in information secure.
8. Reports, exports, and sharing outside MOMENTS
You may generate PDF reports or CSV exports and share them with healthcare professionals, family members, or others. You are responsible for reviewing an export and choosing its recipients. Once information leaves MOMENTS, the recipient's handling of it is outside our control.
9. Intellectual property
The Service, including its software, design, branding, and original materials other than user content, is protected by intellectual-property laws. These Terms give you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purpose. They do not transfer ownership of the Service to you.
10. Availability and changes
We work to keep MOMENTS reliable, but the Service is provided on an "as is" and "as available" basis. We do not promise uninterrupted operation, error-free synchronization, delivery of every notification, compatibility with every device, or permanent availability of every feature. We may maintain, modify, suspend, or discontinue parts of the Service. Where practical, we will provide notice of material changes.
11. Disclaimers
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, noninfringement, and accuracy. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, or harm arising from reliance on user-entered records, notifications, Care Circle communications, or exports. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid for MOMENTS in the twelve months before the claim or US $100. This limitation does not apply where prohibited by law.
13. Suspension, termination, and deletion
You may stop using MOMENTS at any time and may delete your account through Settings in the mobile app or browser workspace. Deletion is permanent and is described on the Account Deletion page. We may suspend or terminate access for serious or repeated violations of these Terms, security threats, unlawful conduct, or harm to other users. Provisions that by their nature should survive termination will remain effective.
14. Changes to these Terms
We may update these Terms as MOMENTS evolves. The effective date above identifies the current version. If a change is material, we may provide notice or request renewed acceptance where required. Continuing to use the Service after updated Terms take effect means you accept them, unless applicable law requires a different form of consent.
15. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any mandatory consumer protections available in your place of residence still apply.
